I do not provide representation to non-attorneys. I am a legal consultant and my services are contracted by family law attorneys, only.

My services include:

  • Reviewing retirement plan documents

  • Assisting with comprehensive retirement and financial account discovery

  • Providing litigation support, including expert testimony

  • Negotiating and drafting key separation/settlement agreement provisions related to retirement and financial assets

  • Assisting divorce/dissolution mediators, and in collaboration

  • Serving as a third-party "QDRO-neutral" in Collaborative Divorce cases

  • Providing written interpretations of opposing party QDROs

  • Drafting QDROs in accordance with state and federal law, as well as individual plan terms

  • Providing explanations of material QDRO terms to share with your client and obtain sign-off for your file

  • Dividing state and federal government plans, non-qualified retirement assets, and other forms of deferred compensation, which are not subject to QDRO

  • Offset of financial assets with other property; net present value analysis

Passive growth trace analysis: If one of the parties contributed to an account (for example, an IRA, brokerage, 401(k), 403(b), 457(b), ESOP, profit sharing, or savings plan) before or after the marriage, or rolled over a prior non-marital asset into the current, I provide ‘tracing’ services to determine the passive growth on such separate property.

Spousal & child support arrearages: Remember, QDROs are strategic and creative tools beyond determining marital property rights. My services also include drafting a QDRO to pay child support obligations and arrearages, as well as alimony.
