QDRO Drafting
A QDRO must be individually tailored and drafted to accurately reflect the parties' property settlement agreement and/or findings of the court. Doing so requires an understanding of:

  • Specific terms and nuances of each retirement plan, as well as the plan’s internal QDRO procedures and rules

  • Federal and state laws governing the plan

  • State domestic relations law as it relates to the classification and division of marital property rights and child support matters

Your clients are best served when these complexities are addressed by an attorney experienced in all three of these areas.

The amount of time necessary to complete a QDRO depends on a number of factors, including the availability of data regarding the plan benefits, sophistication of plan terms, cooperation of the parties, efficiency of the courthouse, and review time by the court and the plan administrator
